Miami-Dade County Living Will Attorney

Make Your Wishes Known with an Advance Healthcare Directive

Living wills, designations of health care surrogates and durable powers of attorney are powerful tools to help you spell out your wishes during times of incapacitation or when you are dealing with end-of-life issues. Living wills can be as complex or as simple as you want them to be.

The important take-away is to have one in place, no matter how young or old you are. Tragedy can strike at any time. Be prepared.

Burden-Relieving Options

A living will appoints a person (health care surrogate) to carry out your wishes during end-of-life matters. This is a legal document that must be followed. This can include the life-saving measures that you want taken on your behalf; these can deal with hydration, nutrition, various medical interventions and more.

Durable powers of attorney can help your loved ones avoid costly legal guardianship processes on your behalf. There are two different powers of attorney:

  • A health care power of attorney gives someone whom you trust the power to make certain limited decisions on your behalf during a time of your incapacitation or recovery from surgery.
  • A financial power of attorney allows your designated person to make financial decisions on your behalf and to take care of your financial affairs during a set period of time.

Living Wills Are for Everybody

In the case of Terry Schiavo, the Florida woman who fell into a coma after a serious car accident, she did not have a living will and her thoughts on end of life issues were not known. Do you want your loved ones having to make such hard decisions on your behalf? A living will may have prevented the difficult legal fight between Terry's husband and Terry's parents over taking her off life support. Tragedy can strike at any moment. Be prepared.
