What Is Probate?
Probate is the orderly identification and gathering of the decedent's assets, validation and satisfaction of debts owed by the Estate and distribution of the remaining assets to the beneficiaties pursuant to the decedent's will, if one exists, or pursuant to statute if there is no will. Once an estate is opened, the attorney accounts for all assets, valuing the estate, pays off all debts and distributes what is left of the estate among the heirs, according to the deceased person's will.
Probate can involve fairly complex situations: it can include a family business left to one heir only or it can involve a distribution of 7 properties and a closely held business to 10 beneficiaries, including five living in other countries. Or it could involve distribution of blocked Cuban accounts. Probate can range from a simple distribution of personal property to the more complex issues of determination of heirs, including paternity issues.

When Wills or Trusts Are Contested and Probate Is Litigated
Probate does not flow smoothly when there is a question about the validity of a will or the un-natural disposition of the decedent's property. This may include issues of a friend or family member who exerted undue influence that caused a freeze out of expected heirs. General litigation is then conducted similar to other lawsuits.
Creditors Cannot Take a Home — Florida Homestead Act
Creditors may not take a deceased person's home (if it is their homestead).
The personal representative and beneficiaries will never be liable for the deceased's debt. Any valid debts will be paid from the estate assets prior to the distribution to the heirs.
