RANDY BRYANT: The difference between probate administration and litigation is simple. Administration is when everything goes right. We marshal the decedent's assets; we give them to the beneficiaries that are supposed to receive them. Litigation is when something or everything goes wrong. Assets are going where they shouldn't go or not going to where they should go. That's what litigation's about.

It's important that you have a probate attorney. Probate has its own special set of rules. So if you're an attorney who's not generally practicing in probate, you won't know those rules and you can make mistakes that are catastrophic to an estate. That's the reason that I limit my practice to probate, guardianship and personal injury.

An advantage I have over most transactional attorneys, and probate administration is mostly a transactional practice, is that I've actually been to trial. Most probate attorneys don't have that experience. They've done the administration but not the litigation. And I have done the litigation. I have gotten the verdicts.

One of the things that I try to remember when I meet a new client is that this is an extremely traumatic time in their life. It's not just about the legal; it's about who they are as a person and how I can help them get through this time.
